There is a good post on feministing.com about the recent settlement for at least $68.7 by Johnson & Johnson of hundreds of Ortho Evra lawsuits. The dosage of estrogen administered by these birth control patches is about 60% higher than from the conventional “pill,” causing women to suffer blood clots, strokes and even death.
By the time the FDA first alerted consumers in 2005 to the dangers associated with the Ortho Evra patch, it was too late; the alert came 4 months after the AP reported that a dozen women died as a result of blood clots related to the patch: CBS News.
This tragic result should not be forgotten as the Supreme Court this session decides whether FDA approval of pharmaceuticals preempts state law tort claims such as those filed by the plaintiffs in this case.
